CHAPTER I GENERAL PROVISIONS

Article 1. This Law is enacted in accordance with the constitution and the relevant laws with the intent to implement a strategy of relying on science and education to develop the country and achieve sustainable development. It will also support the promulgation of science and technology, raise the scientific and educational levels of the citizens, and promote economic development and social progress.


Article 2. This Law shall apply to activities held by the state and the public to promulgate knowledge of science and technology, advocate scientific conduct, disseminate scientific ideologies and advance scientific spirit.

The promulgation of science and technology shall be carried out in methods that the public can easily understand, accept and participate in.


Article 3. State organs, the military, societal organizations, corporate enterprises, public institutions, rural grassroots organizations and other associations shall carry out the work of promulgation of science and technology.

All citizens have the right to participate in activities associated with the promulgation of science and technology.


Article 4. The promulgation of science and technology is a welfare undertaking, and as such is an important component of socialist material progress as well as cultural and ethical progress. It is a long-term mission of the state to develop the promulgation of science and technology.

The state supports the promulgation of science and technology in outlying poor areas as well as those inhabited by ethnic minorities.


Article 5. The state protects the lawful rights and interests of the organizations and employees associated with the promulgation of science and technology while encouraging the aforesaid organizations and employees to independently carry out activities to promulgate science and technology. It also founds establishments to promulgate science and technology in accordance with the law.


Article 6. The state supports the non-governmental sector in founding establishments to promulgate science and technology. The non-governmental sector may operate in consideration of the market mechanism when founding establishments to promulgate science and technology.


Article 7. The activities associated with the promulgation of science and technology shall adhere to the society- and frequency-based needs of a broad range of citizenry and shall be implemented in various forms considering the actual and local conditions.


Article 8. The activities associated with the promulgation of science and technology shall adhere to the scientific spirit while opposing and rejecting pseudo-science. No entity or individual shall engage in any activity in the name of promulgation of science and technology that harms the public interest.


Article 9. The state supports and promotes cooperation and exchange with foreign parties to promulgate science and technology.



CHAPTER II ORGANIZATION AND ADMINISTRATION

Article 10. The people's government at all levels shall lead the activities to promulgate science and technology by a) including activities to promulgate science and technology in plans of economic and social national development, and b) by creating a supportive environment and beneficial conditions for the implementation of the promulgation of science and technology.

The people's government at the county level or above shall set up a system to coordinate the promulgation of science and technology.


Article 11. The administrative department of science and technology under the State Council shall be responsible for formulating the planning of promulgation of science and technology for the nation. It will also practice policy guidance, implement supervision and inspection, and promote the development of the promulgation of science and technology.

Other administrative departments under the State Council shall, pursuant to their respective scope of duties, be responsible for the relevant activities to promulgate science and technology.

The administrative department of science and technology and other administrative departments under the people's government at the county level or above shall, under the leadership of the people's government at the same level, and pursuant to their respective scope of duties, be responsible for the relevant activities to promulgate science and technology in the local area.


Article 12. Science and technology associations compose the main non-governmental sector in the promulgation of science and technology. Science and technology associations organize and implement activities to promulgate science and technology in accordance with the society- and frequency-based needs of a broad range of citizenry. This sector also supports the relevant public organizations, enterprises, and public institutions in implementing the promulgation of science and technology, coordinates with the government to formulate the planning of promulgation of science and technology, and provides advice to the government to make decisions about the promulgation of science and technology.



CHAPTER III PUBLIC RESPONSIBILITIES

Article 13. The promulgation of science and technology is the common goal of the entire society. All circles in the society shall organize and participate in various activities to promulgate science and technology.


Article 14. All schools and other educational institutions shall consider the promulgation of science and technology an important component of quality education. These institutions shall organize the students to implement various activities that promulgate science and technology.

Science and technology museums (stations), scientific and technological activity centers, and other educational bases for the promulgation of science and technology shall organize and implement activities to promulgate science and technology as well as extracurricular activities for juveniles.


Article 15. Scientific research and technological development institutions, institutions of higher education, and natural and social science public organizations shall organize and support the scientific and technological employees and teachers to implement activities to promulgate science and technology. The aforesaid organizations will also encourage employees to propagandize the promulgation of science and technology in combination with their own work, and shall, if allowed by local conditions, open laboratories, showrooms, and other facilities to the public, as well as hold lectures and provide consulting.

The scientific and technological employees and teachers shall utilize their own advantages and specialties while actively participating in and supporting the promulgation of science and technology.


Article 16. Press and publication institutions and organizations, as well as radio, film and television, and culture organizations etc. shall exploit their own advantages to propagandize the promulgation of science and technology.

Comprehensive newspapers and periodicals shall set up special columns and editions for the promulgation of science and technology; radio and television stations shall set up or broadcast programs on the promulgation of science and technology on popularization of science and technology; film and television production, publication or projection institutions shall increase their production, publication and projection of cinematographic or television programs on the promulgation of science and technology; book publication and distribution institutions shall support the publication and distribution of books on the promulgation of science and technology; comprehensive internet websites shall set up web pages on the promulgation of science and technology; cultural sites such as science and technology museums (stations), libraries, museums, and cultural centers shall schedule educational functions on the promulgation of science and technology.


Article 17. State organs and public institutions of medical treatment and sanitation, family planning, environmental protection, land resources, physical culture, meteorology, seismology, cultural relics, tourism, etc. shall, in combination with their own work , carry out activities to promulgate science and technology.


Article 18. Public organizations such as work unions, communist youth leagues, and women's federations shall, in combination with the features of their own goals, organize and implement activities to promulgate science and technology.


Article 19. Corporate enterprises shall, in combination with technical innovations and skill training for employees, implement activities to promulgate science and technology, and may, if allowed by the local conditions, establish houses and facilities open to the public for the promulgation of science and technology.


Article 20. The state supports the promulgation of science and technology in rural areas. The rural grassroots organizations shall, dependent upon the needs of local economic and social development, and according to the surrounding scientific production and civilized life, schedule town or township organization functions to promulgate science and technology and implement the promulgation of science and technology.

All rural economic organizations, agricultural technology popularization institutions, and rural professional technology associations shall, in combination with the promulgation of advanced and suitable technologies, disseminate knowledge of science and technology to farmers.


Article 21. Urban grassroots organizations and communities shall, by utilizing the local resources of science and technology, education, culture, sanitation, tourism, etc., implement activities to promulgate science and technology in combination with the residents' needs in life, study, health, and entertainment.


Article 22. The operating and managing entities of public places such as parks, stores, airports, vehicle stations, and docks, shall increase the propaganda on the promulgation of science and technology within their own jurisdictional scope.



CHAPTER IV GUARANTY MEASURES

Article 23. The people's government at all levels shall include the expenses for popularization of science and technology in the financial budgeting at the same level, and will gradually increase the standard of input in the promulgation of science and technology as well as guarantee the smooth execution of the promulgation of science and technology.

The relevant departments under the people's government at each level shall arrange certain budgeting for the activities to promulgate science and technology.


Article 24. The people's government over provinces, autonomous regions, and municipalities directly under the Central Government, as well as the people's government of other places shall, if allowed by the conditions, include the construction of the centers and facilities for promulgation of science and technology in urban and rural construction planning and basic construction plans. It shall also support the utilization, maintenance, and rebuilding of the existing houses and facilities for the promulgation of science and technology.

The centers for the promulgation of science and technology that are built with governmental expenditure shall be allocated necessary full-time employees, be open to the public throughout the year, and award preference to juveniles. The centers will not be diverted for other uses unless it is authorized. In case of any difficulties at the centers with respect to expenses, the government at the same level shall use the public finance to provide subsidies for the centers' normal operation.

For areas where conditions do not allow the establishment of centers for the promulgation of science and technology, the existing facilities of science and technology, education, culture, etc. may be used to execute activities to promulgate science and technology. Galleries, show windows, etc. may be set up for the promulgation of science and technology.


Article 25. The state supports the promulgation of science and technology, and applies tax preferences to the undertaking of promulgation of science and technology in accordance with the law.

Organizations to promulgate science and technology may, if implementing activities to promulgate science and technology, or if holding an undertaking to promulgate science and technology, obtain financial support and donations in accordance with the law.


Article 26. The state encourages public organizations and individuals both at home and abroad to establish funds for the promulgation of science and technology; these will be used to provide financial support for the promulgation of science and technology.


Article 27. The state encourages public organizations and individuals both at home and abroad to donate property to provide financial support for the promulgation of science and technology. Preferences shall be awarded to those who donate property for the implementation of promulgation of science and technology, or to those who invest in the construction of centers and facilities for the promulgation of science and technology, in accordance with the law.


Article 28. The budget for the promulgation of science and technology and the properties donated by public organizations and individuals to provide financial support for the promulgation of science and technology must be used for the implementation of the promulgation of science and technology, and no entity or individual shall withhold, detain, or misappropriate any part of such expenses or properties.


Article 29. The people's government at all levels, science and technology associations, and the relevant entities shall all support the employees of the promulgation of science and technology in implementing the promulgation of science and technology, and shall commend and award organizations and individuals who have made outstanding contributions to the promulgation of science and technology.



CHAPTER V LEGAL LIABILITIES

Article 30. Whosoever, in the name of promulgation of science and technology, performs any activity that harms the public interest, disturbs the public order, or fraudulently obtains property, shall be subject to criticism and education by the relevant department in charge, and be prevented from committing the said acts. If he violates the provisions on administration of public security, he shall be subject to administrative penalties for public security by the public security organ in accordance with the law. If a crime is constituted, he shall be investigated for criminal liabilities in accordance with the law.


Article 31. Whosoever, in violation of the provisions in this Law, withholds, detains, or misappropriates any part of the financial budget for the promulgation of science and technology, or embezzles, or misappropriates donated money or property, shall be ordered by the relevant department to return the budgeted finances, money, or properties within a specified time. The liable person and other directly liable persons shall be subject to administrative sanctions in accordance with the law. If a crime is constituted, he shall be investigated for criminal liabilities in accordance with the law.


Article 32. Whosoever unauthorizedly diverts for other use a center for the promulgation of science and technology that is built with the investments of governmental expenditure shall be ordered by the relevant department to correct this diversion within a specified time. If the case is serious, the liable person and other directly liable persons shall be subject to administrative sanctions in accordance with the law.

Whosoever disturbs the order in a center for the promulgation of science and technology, or damages the center or facilities for the promulgation of science and technology, shall be ordered in accordance with the law to cease the infringements and restore the original condition or compensate for the losses. If a crime is constituted, he shall be investigated for criminal liabilities in accordance with the law.


Article 33. Wherein a state functionary abuses his power, neglects his duty, or commits malpractice for personal gain in the name of promulgating science and technology, he shall be subject to an administrative sanction in accordance with the law. If a crime is constituted, he shall be investigated for criminal liabilities in accordance with the law.



CHAPTER VI SUPPLEMENTARY PROVISIONS

Article 34. This Law shall come into force on the date of its promulgation.
