ADMINISTRATIVE MEASURES FOR THE QUALITY GRADE EVALUATION OF TOURIST AREAS

The Administrative Measures for the Quality Grade Evaluation of Tourist Areas were adopted at the directors' meeting of the National Tourism Administration on July 6, 2005. They are hereby promulgated and shall be implemented as of August 5, 2005.)

Article 1. These Measures are formulated to push forward the quality grade evaluation of tourist areas in an all-round way, regulate the procedures for the quality grade evaluation of tourist areas and promote the development of tourist areas.

Article 2. The quality grade evaluation of tourist areas shall be carried out according to the national standards of the People's Republic of China-The Classification and Evaluation of the Quality Grades of Tourist Areas (GB/T17775-2003)- and the relevant detailed evaluation rules promulgated by the National Tourism Administration.

Article 3. The quality grade evaluation of tourist areas shall comply with the principle of voluntary application, classified evaluation, dynamic management and classified guidance.

Article 4. Any tourist area that has been engaged in business operations of tourism within the territory of the People's Republic of China for one year or more since it formally started business operations may apply for participating in the quality grade evaluation, which may be a tourist area, museum of cultural relics, temple, Taoist temple, mosque, church, area for tourism and holiday, natural protection zone, theme park, forest park, geological park, amusement park, animal park, plantation park, or a tourist area featuring industry, agriculture, economic trade, social science education, military affairs, gym or culture and arts.

Article 5. The "quality grade evaluation of tourist areas" refers to the evaluation of tourist areas that have independent management and service institutions, and no independent evaluation will be made to the parks in park, views in view.

Article 6. The National Tourism Bureau shall organize the formulation of standards on the quality grade evaluation of tourist areas and shall be responsible for the supervision and inspection of the implementation of the standards on quality grade evaluation.

Article 7. The National Tourism Bureau shall establish a National Tourist Area Quality Grade Evaluation Commission, which shall be responsible for the organization and management of quality grade evaluation of the tourist areas throughout the country.

The tourism administrative departments of all provinces shall organize the establishment of a tourist area quality evaluation commission for their respective administrative area and shall report to the National Tourism Bureau for archival purposes. Upon authorization of the National Tourist Area Quality Grade Evaluation Commission, the provincial tourist area quality evaluation commissions shall organize and manage the quality grade evaluation of tourist areas accordingly.

Article 8. For the AAA, AA and A tourist areas, the National Tourist Area Quality Grade Evaluation Commission shall authorize all provincial tourist area quality grade evaluation commissions to take charge of the evaluation. The provincial tourist area quality grade evaluation commissions may further authorize tourist area quality grade evaluation commissions at the prefecture or city level where appropriate.

The AAAA tourist areas shall be recommended by the provincial tourist area quality grade evaluation commissions at the prefecture or city level and shall be evaluated by the National Tourist Area Quality Grade Evaluation Commission.

The AAAAA tourist areas shall come from the AAAA tourist areas. Merely those announced as AAAA tourist areas 1 or more years ago may apply for the qualification of an AAAAA tourist area. The AAAAA tourist areas shall be recommended by the provincial tourist area quality grade evaluation commissions and shall be evaluated by the National Tourist Area Quality Grade Evaluation Commission.

Article 9. The quality grade evaluation work of the tourist areas at all levels shall comply with the procedures - establishment, application, evaluation and announcement.

Article 10. A tourist area that participates in establishing itself as a quality grade tourist area shall, in accordance with the national standards and detailed evaluation rules, work out an establishment plan, clarify the responsibilities and target, and carry the establishment measures into effect.

Article 11. A tourist area shall conduct a self-check after it finishes its establishment plan. If its self-check result conforms to the corresponding grade standards and detailed rules, it shall fill out a Report on the Quality Grade Evaluation of Tourist Area and shall file an evaluation application with the local tourist area quality grade evaluation institution. If the local tourist area quality grade evaluation institution approves the aforesaid application upon examination, it shall recommend the applicant to the superior tourist area quality grade evaluation institution for participating in the corresponding formal quality grade evaluation.

Article 12. The on-the spot evaluation shall be conducted by an evaluation team formed upon the authorization of the tourist area quality grade evaluation institution in charge of the evaluation. The evaluation team may conduct the on-the-spot evaluation by way of making an on-the-spot inspection, checking the materials, and making a selective investigation, etc.

Article 13. If the tourist area meets the relevant standards upon on-the-spot evaluation, the tourist area quality grade evaluation institution in charge of the evaluation shall approve its quality grade and make an announcement.

Article 14. The National Tourist Area Quality Grade Evaluation Commission shall publish the name list of the tourist areas at all grades that have newly passes the evaluation.

Article 15. The on-the-spot work for the tourist area quality grade evaluation shall be undertaken by the inspectors who have the corresponding qualifications. On the basis of the resource type and features of the tourist area to be evaluated, the evaluation team shall include a corresponding expert as a member.

Article 16. The tourist area quality grade evaluation inspectors shall be classified into national inspectors and local inspectors. The national inspectors shall be hired by the National Tourist Area Quality Grade Evaluation Commission. The local inspectors shall be hired by the provincial tourist area quality evaluation commissions.

Article 17. The inspectors shall accept the supervision of the tourist areas. None of them may seek private benefits by unlawful means. The tourist area quality grade evaluation institutions at all levels shall strengthen the supervision and management of the inspectors and shall disqualify those who commit violations from acting as inspectors.

Article 18. Where any authorized tourist area quality grade evaluation institution commits any violation, its superior evaluation institution may revoke the top grade evaluation power authorized thereto.

Article 19. The tourist area quality grade evaluation institutions at all levels shall supervise, inspect and verify the tourist areas they have evaluated. The inspection and supervision may be carried out by way of randomly checking the important areas, checking regularly and publicly, investigating irregularly and privately, making social investigations, listening to the opinions of the tourists, etc. An all-round verification shall be conducted at least once every 3 years.

Article 20. The grade verification work shall be mainly organized and completed by the provincial tourist area quality grade evaluation commissions. The National Tourist Area Quality Grade Evaluation Commission shall conduct such work in a planned way and with focuses.

Article 21. If a tourist area fails to meet the relevant requirements, or if it is complained by any tourist and the circumstance is confirmed true upon investigation, it shall be punished according to the following methods:

(1) The corresponding quality grade evaluation commission shall, in light of the concrete circumstance, make and issue a notice of warning, circulate a notice of criticism, degrade it or revoke its grade. If the tourist area is degraded or its grade is revoked, the corresponding evaluation institution shall make an announcement;

(2) After the tourist area receives the notice of warning, criticism by circulating a notice, degrade or revocation of grade, it shall carefully make a rectification and shall report its rectification to the corresponding grade evaluation institution within the prescribed time limit;

(3) If the tourist area is degraded or its qualification grade is revoked, it shall not apply for a new qualification grade within 1 year as of the date of degradation or grade revocation.

Article 22. The power of the tourist area quality grade evaluation commissions to issue notices of warning, criticism by circulating a notice, degradation or revocation of grade shall be as follows:

(1) If any A, AA or AAA tourist area fails to satisfy the relevant standards, the tourist area quality grade evaluation commission of the province, autonomous region or municipality directly under the Central Government may issue a notice of warning, criticism by circulating a notice, degradation or revocation of grade. The notice of degradation or revocation of grade shall be submitted to the National Tourist Area Quality Grade Evaluation Commission for archival purposes;

(2) If any AAAA or AAAAA tourist area fails to satisfy the standards, the tourist area quality grade evaluation commission of the province, autonomous region or municipality directly under the Central Government may issue a notice of warning, or criticism by circulating a notice, and shall report it to the National Tourist Area Quality Grade Evaluation Commission for archival purposes;

(3) The National Tourist Area Quality Grade Evaluation Commission may make and issue a notice of warning, criticism by circulating a notice, degradation or revocation of grade to a tourist area of any quality grade, but it shall, in advance, notify the tourist area quality grade evaluation commission of the relevant province, autonomous region or municipality directly under the Central Government of the relevant information.

Article 23. The quality grade marks and certificates of tourist areas shall be uniformly produced by the National Tourist Area Quality Grade Evaluation Commission and shall be issued by the corresponding evaluation institutions.

Article 24. A tourist area shall put its quality grade mark at the most eye-catching position of its main entry and shall correctly indicate its quality grade in its publicity materials.

Article 25. The power to interpret these Measures shall remain with the National Tourism Administration.

Article 26. These Measures shall be implemented as of August 5, 2005. The Measures for the Quality Grade Evaluation of Tourist Areas (Spots) formulated on September 30, 1999 shall be abolished simultaneously.
