It is an important strategy of the state and the guideline for doing a good job for overseas employment in the new era to actively promote employment and reemployment, implement the "going out" strategy, and improve the level of opening to the outside world, as well as bring into play the advantages of labor resources of our country through enlarging international exchange. The Exit-Entry Administration of the Ministry of Public Security has, in light of the spirit of the Provisions on the Administration of Overseas Employment Agencies (Order No.15 [2002]) promulgated jointly by the Ministry of Labor and Social Securities, the Ministry of Public Security, and the State Administration for Industry and Commerce, issued the Notice on Relevant Issues concerning Providing Convenience for the Exit of Overseas Employees (No.1414 [2003] of the Exit-Entry Administration of the Ministry of Public Security, hereinafter referred to the Notice). In order to implement the requirements of the Notice together, we hereby distribute the Notice to you, and make the following notice on the relevant issues:
I. Formulating Implementation Measures according to the provisions of the Notice. The Notice is a matching document, which is formulated by the Exit-Entry Administration of the Ministry of Public Security in accordance with the Notice of the State Council on Strengthening Administration on Intermediary Activities of Exit and Entry (No.25 [2000] of the State Council) and the Provisions on the Administration of Overseas Employment Agencies, and which is of great significance for regulating and developing overseas employment intermediary institutions, maintaining the legal rights and interests of the overseas employees, establishing and improving the overseas employment system conforming to the international common practice, and broadening the employment markets, as well as cooperating with the implementation of the "going out" strategy. The labor and security departments of all provinces, autonomous regions and municipalities directly under the Central Government shall organize the relevant personnel to carefully study and master the various requirements of the Notice, and formulate the specific measures for the implementation of the Notice in light of the reality of the local region, and put into effect the various requirements of the Notice.
II. Strengthening system construction and administration on the overseas employment intermediary institutions. All the localities shall, combine closely the implementation of the Notice with the establishment and perfection of the administration systems of overseas employment, and the regulation of the overseas employment intermediary acts with the cleaning up and straightening out of the order of the overseas employment intermediary market. All the labor and security departments at the provincial level shall, according to the relevant provisions of the State Council and the Ministry of Labor and Social Security, seize the opportunity for implementation of the Notice, cooperate closely with the local departments of public security and administrative departments for industry and commerce, continue to push forward the construction of the overseas employment administration institutions and systems, strictly investigate into and punish the illegal intermediary activities of overseas employment; and strengthen supervision over, administration and inspection on the approved overseas employment intermediary institutions, regulate the intermediary acts of overseas employment, and make investigation into the problem found out and handle it in time, so as to ensure the good order of the overseas employment intermediary market, and faithfully maintain the legal rights and interests of overseas employees.
III. Strictly enforcing the system of issuing exit certificate, and putting an end to acts of illegal exit. All the labor and security departments at the provincial level shall, strictly in accordance with the requirements of the Notice, make careful examination on the application of the personnel for exit, which is reported by the intermediary institutions, and put it on records. The said departments shall also formulate uniform Exit Certificate of Overseas Employees according to the format attached in the Notice, and issue the certificate according to the records of scripts and seal of the signers submitted to this Ministry. Any alteration in the signers or the seal shall be reported to this Ministry in time for renewal of the former contents of records.
IV. Various activities of publicity shall be carried out in light of the local reality. The labor and security departments of all provinces, autonomous regions and municipalities directly under the Central Government may carry out various publicity activities in light of the local reality. The role of guidance of public opinions of media such as the television, broadcast, newspapers and periodicals, internets and other market information network, etc., shall be brought into full play to continue the publicity of the relevant systems and policies of overseas employment intermediary administration, so as to improve the ability of the many job seekers to discriminate the illegal overseas employment agencies, enhance the overseas employment intermediary institutions to voluntarily implement the relevant policies and systems of overseas employment intermediary markets, enlarge the degree of public recognition of the overseas employment intermediary institutions, and pave the way for building a favorable atmosphere of public opinions for implementation of the Notice.
V. All the localities shall make summary on the conditions concerning the issuance of exit certificates, and submit them to the Department of International Cooperation of this Ministry and the Exit-Entry Administration of the Ministry of Public Security.
