This circular is promulgated as follows, with a view to strengthening and regulating the management of working capability appraisal, to making good preparation for the working capability appraisal work before the implementation of the Regulations on Employment Injury Insurance and according to the Regulations on Employment Injury Insurance and to principles specified in relevant documents of the State Council:

I. Working capability appraisal is a basic work for the management of employment injury insurance, which concerns the personal interests of the injured employee. All competent local governments shall pay high attention to this work, and shall realize the normalization of appraisal procedure, the specialization of the appraiser and the standardization of the appraisal criteria by developing management regulations, organizing management teams and improving management methods.

II. The labor and social security administrations of all competent provinces, autonomic regions, municipalities directly under the Central Government, and districted municipalities shall confer without undue delay with representatives from the personnel administration, health administration, labor union, undertaking organization and employing entity, shall set up a working capability appraisal committee and regulate its work as soon as possible, and shall set up a working body of the appraisal committee, of which a person (persons) shall be specially assigned to take responsibility for the daily work.

III. All competent local governments shall formulate specific regulating measures on the working capability appraisal, perfect management regulations of the appraisal work, and establish and improve corresponding working system to guarantee the normal development of the appraisal work.

IV. The working capability appraisal committee shall set up a database of medical and health experts according to requirements in the Regulations on Employment Injury Insurance. The number and specialties of the expert in the database shall be enough to meet the professional requirements and technical requirements of the working capability appraisal. The working capability appraisal committee shall take full consideration of the appraisal opinions of the expert team before making the appraisal conclusion, and shall guarantee the objectiveness, impartiality and accuracy of the appraisal conclusion.

V. Working capability appraisal shall be done according to working capability appraisal standards developed by the labor and social security administration under the State Council together with the health administration under the State Council and other departments. The Disabled Degree Appraisal of Employees' Injuries and Occupational Diseases (GB/T16180-1996) shall be applicable for the time being before the said appraisal standards are promulgated.
