NOTICE OF THE STATE ADMINISTRATION OF FOREIGN EXCHANGE ABOUT TRAVEL AGENCIES ORGANIZING TOURS TO HONG KONG AND MACAO FOR DOMESTIC RESIDENTS
 
(No.31 [2002] of the State Administration of Foreign Exchange promulgated on March 20, 2002, which shall come into force as of April 10, 2002)

In order to strengthen and regulate the administration of the travel agencies' organizing tours of domestic individual residents to Hong Kong and Macao, the Notice on the Relevant Issues Concerning the Tours of Domestic Residents to Hong Kong and Macao (No.91 [2001] of the National Tourism Administration) (see attachment 1) and the Announcement of the National Tourism Administration (No.1 of 2002) (see attachment 2) of the National Tourism Administration are hereby transmitted to you, and the issues of foreign exchange administration relating to travel agencies' organizing tours of domestic residents to Hong Kong and Macao are hereby notified as follows:

I. The banks may handle the procedures for exchanging money relating to the domestic residents' individual tours to Hong Kong and Macao at their own expenses only for the agencies listed in the List of Travel Agencies Licensed to Manage the Tours of Mainland Residents to Hong Kong and Macao.


II. Where the travel agencies organize domestic residents' individual tours to Hong Kong and Macao at their own expenses (hereinafter referred to the tours to Hong Kong and Macao), the involved procedures for exchanging money may only be handled at the banks authorized by the State Administration of Foreign Exchange or the branches thereof of the places where the agencies are located (hereinafter referred to the banks).


III. When handling the procedures for exchanging money for the tourists traveling to Hong Kong and Macao, the travel agencies shall, in accordance with the principle of actual need of travel expenses, use the money paid for the travel expenses of tours to Hong Kong and Macao to purchase foreign exchange which shall be directly remitted abroad or allocated to the special accounts of foreign exchange, approved by the foreign exchange administrations, for tours abroad of the travel agencies, and the remaining sum shall be used to buy the cash in foreign currencies for the tourists as personal pocket money, the travel agencies shall collect Renmingbi from the tourists by rigidly following the foreign exchange rate of the day of money-exchanging.


IV. The amount of foreign exchange purchased by the travel agencies for the tourists traveling to Hong Kong and Macao (referring to the total of the purchased foreign exchange and cash) shall not exceed the total of the maximum amount of foreign exchange supplied to each tourist by the State. Where the expenses of tours to Hong Kong and Macao exceed the standard of the State for personal purchase of foreign exchange, the travel agencies may, upon the approval of the foreign exchange administrations, remit the lacking amount of travel expenses abroad through their special accounts of foreign exchange for entry tours.


V. When a travel agency exchanges money for the tourists traveling to Hong Kong and Macao, the Renmingbi needed for foreign exchange purchase must be paid to the bank by check or transfer account, and the following materials shall be submitted to the bank:

(1) The official letter of the travel agency to apply for exchanging money (listing in details the number of tourists of the tour to Hong Kong and Macao, the destination, the purchased travel expenses and personal pocket money);

(2) The List of Tour Groups of Mainland Residents to the Special Administration Region of Hong Kong and the Special Administration Region of Macao (hereinafter referred to the List) issued by the administrative department of tourism;

(3) The contract meeting the relevant requirements of the National Tourism Administration signed between the travel agency and the reception agency of tours to Hong Kong and Macao; and

(4) The Pass to/from Hong Kong and Macao of each tourist and the valid endorsement.


VI. A bank shall examine and verify the authenticity of the following contents when handling the sale and payment of foreign exchange for tours abroad:

(1) Whether the agency is one included in the List of Travel Agencies Licensed to Manage Tours of Mainland Residents to Hong Kong and Macao promulgated by the National Tourism Administration;

(2) Whether the "signature of the authorizer" and seal of the organizing agency on the List are consistent the signature and seal kept by the bank, and whether the certificates and materials as provided for in Article 5 of this Notice are authentic and complete;

(3) With respect to the tours to Hong Kong, whether the Hong Kong reception agencies are included in the List of Travel Agencies of Hong Kong Receiving Chinese Tour Groups.

After handling the procedures for exchanging money, the bank shall indicate a mark of exchanging on each Pass to/from Hong Kong and Macao, and must input the tourist names, genders, passport numbers, ID card numbers, time of foreign exchange purchase, amount of foreign exchange purchased, and other information provided by the travel agency into computers for reference after supplying foreign exchange each time.


VII. Other matters not mentioned in this Notice shall be carried out according to the Notice of the State Administration of Foreign Exchange on the Relevant Issues of Administration of Tourism Foreign Exchange Receipt and Payment of Travel Agencies (No.3 [2001] of the State Administration of Foreign Exchange) and the Notice of the State Administration of Foreign Exchange on the Relevant Operations of Administration of Tourism Foreign Exchange of Travel Agencies (No.122 [2001] of the State Administration of Foreign Exchange).


VIII. This Notice shall be put into practice from April 10, 2002.

After reception of this Notice, the branches shall transmit it to their subsidiaries, and the Head Office of the China's Bank and the head offices of designated foreign exchange banks shall transmit it to their branch banks as soon as possible. Please report to the State Administration of Foreign Exchange if any problem is encountered in the implementation.
