NOTICE OF THE STATE ADMINISTRATION OF FOREIGN EXCHANGE ON FOREIGN EXCHANGE IN TOURISM

In order to strengthen the administration of foreign exchange in tourism and regulate foreign exchange purchase for tourism by group-organizing agencies and individuals, in accordance with the Measures for the Administration of Chinese Citizens' Overseas Tour (Order No.354 of the State Council of the People's Republic of China) promulgated by the State Council, the Public Announcement of the National Tourism Administration (No.10 of year 2002) and the Notice on Starting Using the 2002 Version of the Name List of Groups of Chinese Citizens for Overseas Tour(No.79 [2002]) promulgated by the National Tourism Administration, the issues concerning the administration of foreign exchange in tourism are hereby notified as follows:


I. According to the provisions of the Measures for the Administration of Chinese Citizens' Overseas Tour of the State Council, the National Tourism Administration (NTA) sorted out the travel agencies that operate the business of Chinese citizens' overseas tour, and uniformly adjusted the group-organizing agencies and tickets agencies of overseas tour which were approved in 1997 to China International Travel Service Head Office and other 527 travel agencies, which have been approved this time to operate the business of Chinese citizens' overseas tour.

Any group-organizing agency approved this time that hasn't opened the foreign exchange account for overseas tour may apply to the administration of foreign exchange of the place where it is located for opening the special foreign exchange account for overseas tour. When a travel agency applies for opening the foreign exchange account for overseas tour, it shall, apart from submitting the relevant materials required in the Notice of SAFE on the Relevant Issues of Foreign Exchange Administration in Tourism of the Travel Agencies (No.3 [2002] of SAFE), provide the official reply by NTA on approving it to be a group-organizing agency and the new Operation License of Travel Agency issued by NTA.

The branches and designated foreign exchange banks shall, strictly in accordance with the List of Travel Agencies that May Operate the Business of Chinese Citizens' Overseas Tour promulgated by NTA, make the examination and approval, open the special account for overseas tour and handle the sale of and payment in foreign exchange for overseas tour group fees for the qualified travel agencies.


II. In accordance with the provisions in the Notice on Starting Using the 2002 Version of the Name List of Groups of Chinese Citizens for Overseas Tour, the new version of List of Groups of Chinese Citizens for Overseas Tour shall be put into use from September 1, 2002, and the former 1997 version of Examination Certification of Chinese Citizens' Overseas Tour at Their Own Expenses and the Name List of Groups of Chinese Citizens for Overseas Tour at Their Own Expenses shall be abolished simultaneously, therefore, SAFE has decided to modify the relevant contents of the Notice of SAFE on Adjusting the Policies on Purchase of Foreign Exchange by Chinese Citizens for Overseas Tour (No.55 [2002] of SAFE) (hereinafter referred to the Notice) and the Detailed Rules for the Implementation of the Administration of Purchase of Foreign Exchange by Domestic Individual Residents (No.69 [2002] of SAFE) (hereinafter referred to the Detailed Rules) as follows from September 1, 2002:

(1) "The group-organizing agency shall provide the copy of the Name List of this overseas tour to the tourists" prescribed in Paragraph 3, Article 4 of the Notice shall be modified as "the group-organizing agency shall provide to the tourists the copy of the fourth page (the page kept by the group-organizing agency) of the Name List of this overseas tour which has been confirmed by seal of the travel agency (only the page with the name of the tourist is required).

(2) "The name list of the group of Chinese citizens for overseas tour" confirmed by the travel agency (the copy shall bear the official seal) " in the certifications required for the purchase of foreign exchange for overseas tour prescribed in Paragraph 1, Article 17 of the Detailed Rules shall be modified as "the copy of the fourth page (the page kept by the group-organizing agency) of ¡®the name list of the group of Chinese citizens for overseas tour¡¯ confirmed by seal of the travel agency (only the page with the name of the tourist is required). "

(3) "The Name List of the Group of Chinese Citizens for Overseas Tour which is verified and issued by the department of tourism administration and actually used by the group-organizing agency" prescribed in Paragraph 2, Article 7 of the Notice shall be modified as "the fourth page of the Name List of the Group of Chinese Citizens for Overseas Tour which is verified and issued by the department of tourism administration and actually used by the group-organizing agency (the bank shall, after examination, affix the mark of ¡®foreign exchange sold¡¯ and indicate the date of the sale on the page, and shall copy it for reference) ".

(4) The "to submit the Name List bearing the seal of border inspection to the bank for examination and copying for reference" prescribed in Article 8 of the Notice shall be modified as "to submit the third page of the Name List (the page kept by the department of tourism administration) to the bank for examination and copying for reference".

(5) In consideration of the situation that this Administration has started using the system of administration information of purchase of foreign exchange by individual residents (hereinafter referred to the system of individual purchase of foreign exchange), and in order to provide convenience for tourists going abroad to purchase foreign exchange for personal use, "the tourist shall, before exiting the border, go through the procedures for purchase of foreign exchange for personal use with the bank in person" prescribed in Article 4 of the Notice shall be cancelled. The tourist may, before exiting the border, either go through the procedures for purchase of foreign exchange for personal use with the bank that has adopted the system of individual purchase of foreign exchange in person, or entrust others to go through the procedures for him. Where any other person is entrusted to go through the procedures, the entrusted person shall, apart from providing the certifications formerly prescribed, provide the identity card or household register of himself.

The branches shall, upon receiving this Notice, transmit it to the sub-branches, the Chinese-funded and foreign-funded designated foreign exchange banks under their respective jurisdiction as soon as possible, and the Chinese-funded designated foreign exchange banks shall, upon receiving this Notice, transmit it to their respective branches as soon as possible. If any problem is encountered in the implementation, please report to the department of current account administration of SAFE timely.
