NOTICE OF THE STATE ADMINISTRATION OF FOREIGN EXCHANGE ON THE EXPERIMENT OF SELLING FOREIGN EXCHANGE TO DOMESTIC INDIVIDUAL RESIDENTS TRAVELING TO THE BOARDER AREAS OF ADJACENT COUNTRIES

In order to facilitate Chinese domestic individual residents to travel in the boarder areas of adjacent countries, improve the administration on the business of sale of exchanges for tourism, the State Administration of Foreign Exchange decides to experiment the business of sale of exchange to domestic individual residents traveling to the boarder areas of Russia and other countries of CIS at the boarder ports of Heilongjiang Province (hereinafter referred to Heilongjiang), Inner Mongolia Autonomous Region (hereinafter referred to Inner Mongolia), Xinjiang Urgur Autonomous Region (hereinafter referred to Xinjiang), and hereby gives its notice on the relevant experimental matters as follows:


I. A domestic individual resident who intends to go to the boarder area of an adjacent country via a boarder port in Heilongjiang, Inner Mongolia or Xinjiang for travel, may entrust a travel agency entitled to handle boarder travel (hereinafter referred to "travel agency") to go through the formalities of purchasing foreign exchanges in a bank in the concerned province or autonomous region, which is authorized by the State Administration of Foreign Exchange or its branch or sub-branch (hereinafter referred to "foreign exchange bureau") to run the business of sale of exchanges for domestic individual residents.


II. Any bank handling sale of exchanges shall undertake such business for domestic individual residents' boarder travel through the "Information System on Management of Purchase of Exchanges by Domestic Individual Residents" of the State Administration of Foreign Exchange, and offline operation is strictly prohibited.


III. The standard for the purchase of exchanges under the item of boarder travel by domestic individual residents shall be the equal value of US$100 per day per person, provided that the maximum amount of exchanges purchased for each time of boarder travel shall not exceed the equal value of US$500.


IV. A travel agency shall bring the "Application Form for Purchasing Exchanges for Overseas Travel in Boarder Areas" (see the annex), the originals and photocopies of the visaed passports for private affairs or passes for boarder travel, the identification cards or household registration books of the domestic individual residents who participate in the boarder travel, to go through the formalities for purchase of exchanges in the bank.


V. A bank shall strictly verify the relevant documents provided by the travel agency, and shall, after confirming that there is no error, handle the sale of exchange according to the provided standards, and affix the seal of "Exchanges Supplied" and the date of sale of exchange on the passports for private affairs or passes for boarder travel. Meanwhile, it shall indicate the words of "Actual Days for Staying Abroad" in the "Remark Column" on the interface of "Boarder Travel" in the "Information System on Management of Purchase of Exchanges by Domestic Individual Residents".


VI. A travel agency shall, after purchasing exchanges on behalf of the domestic individual residents for boarder travel, bring the passports for private affairs or passes for boarder travel, which are affixed with the entry and exit records by the frontier defense department, to go through the formalities of cancellation after verification in the original bank handling purchase of exchanges prior to the end of the boarder travel and the submission of the said passports or passes to the public security department. If the travel agency fails to, in accordance with the provisions, go through the formalities of cancellation after verification for the purchase of exchanges for boarder travel on behalf of the domestic individual residents, the bank shall not handle new business of sale of exchange for the travel agency.


VII. The foreign exchange bureau in an experimental area shall regularly or irregularly inspect the travel agencies' purchase of exchanges for boarder travel on behalf of the domestic individual residents, and shall impose penalties in accordance with the "Regulation of the People's Republic of China on Foreign Exchange Control" upon any agency that violates the present notice or other provisions on foreign exchange control; if the case is serious, the travel agency's business of purchase of exchanges for boarder travel on behalf of the domestic individual residents shall be ceased. Meanwhile, the foreign exchange bureau shall strengthen the inspection on the banks handling such sale of exchange, and urge them to handle the business of sale of exchanges in accordance with the provisions; with regard to any bank handling the business of sale of exchange in violation of the provisions, the foreign exchange bureau shall impose penalties in accordance with the relevant provisions.


VIII. Other matters concerning the purchase of exchanges for domestic individual residents to travel in the boarder areas of adjacent countries via the boarder ports in Heilongjiang, Inner Mongolia and Xinjiang, shall be dealt with in accordance with the relevant provisions in the "Notice of the State Administration of Foreign Exchange on Distributing the 'Detailed Rules for the Implementation of Administration of Purchase of Exchanges by Domestic Individual Residents'" (No. 68 [2002] Promulgated by the SAFE).


IX. The present notice shall come into trial implementation on the date when it is received.
