In accordance with the scheme on reform of the organizations under the State Council adopted at the first meeting of the Tenth National People's Congress and the Circular of the State Council on Organizational Establishment (No.8 [2003] of the General Office of the State Council), the former State Development Commission is reorganized as the State Development and Reform Commission (SDRC), which is an organization under the State Council. SDRC is a macro-control department that comprehensively studies and draws up policies on economic and social development, conducts overall balance, and directs the overall economic system reform.
CHPATER I ADJUSTMENT OF FUNCTIONS
(1) Functions excluded
The former State Development Planning Commission's function of organizing implementation of the plan of imports and exports of agricultural product shall be transferred to the Ministry of Commerce.
(2) Functions included
1. Functions of the former Economic System Reform Office of the State Council.
2. Functions of the former State Economic and Trade Commission, such as industrial planning, formulation of industrial policies, adjustment of economic operations, administration of the investment in technical reform, macro direction of the development of enterprises of multiple ownership systems, promotion of the development of small- and medium-sized enterprises, formulation of the plan of imports and exports of important industrial products and raw materials, promotion of the saving and comprehensive utilization of resources, driving the technical advancement, development and manufacturing of important equipment, and the administration of salt industry.
(3) Functions transformed
1. Accelerating the reform of investment and financing systems. SDRC shall bring into better play the adjustment role of market mechanism on economic activities, establish the status of the enterprises as the investment subjects, regulate the government's investment acts, and gradually establish a new investment and financing system which includes investment subjects' autonomy in decision-making, independent examination of loans by banks, diversified financing methods, standardized intermediary services, and effective macro-control by the government. The administration of investment in infrastructure construction and the administration of investment in technical reform shall be integrated as the administration of investment in fixed assets, the emphasis of macro-administration of investment shall be transferred to optimizing the investment and industrial structures, well arranging the major projects, preventing repeated construction, and enhancing the economic benefits of investment. The scope of the investment projects subject to examination and approval shall be further reduced, and the systems of registration and record shall gradually be applied to non-major projects and non-restricted projects that are constructed by the enterprises by using non-government investment and that are in line with the industrial policies of the state. With respect to the investment projects subject to administrative examination and approval, the examination and approval links shall be reduced, the procedures shall be standardized, time limits shall be fixed, and the efficiency and transparency shall be improved. The local governments' authority to make investment in the field of public services by using self-owned fund shall be further expanded. The system of export consultation and demonstration shall be improved, thus to enhance the scientific examination and approval of investment projects. The system of post evaluation and supervision of government investment projects shall be established, and the system of responsibility for examination and approval of investment projects shall be improved.
2. The overall direction and comprehensive coordination in macro-control shall be strengthened, and the affairs of micro-administration shall be earnestly reduced. Study of the major issues concerning economic and social development, reform, and stability shall be enhanced, and the overall work of economic and social development and of reform and opening shall be coordinated comprehensively. The guidance for implementation of the sustainable development strategy and the coordination of major issues shall be strengthened, thus to promote coordinated development of the economy and the resources and environment. According to the requirements on carrying out new ways of industrialization, the guidance for industrial development shall be strengthened, industrial polices shall be studied, formulated, and implemented, and efforts shall be made in the drawing up of energy development strategies and planning and the strategic reserve of energy. And the coordination of outstanding and major problems in daily economic operations shall be strengthened.
3. The direct intervention of administrative examination and approval to economic activities shall be reduced in an earnestly way, and the function of studying and drafting development strategies, planning, and macro policies shall be intensified. The administration of industries in competitive fields shall be changed into macro-direction, and self-regulation of industries shall be promoted. The relevant departments' function of determining the total amount of loans of policy-oriented banks, and determining the total amount of loans of commercial banks and the direct financing used in investment in fixed assets shall be cancelled.
CHAPTER II MAJOR FUNCTIONS
(1) Drawing up and organizing the implementation of the strategies, middle- and long-term planning, and annual plans of national economic and social development; presenting the targets and policies of national economic development and of optimizing major economic structures; proposing suggestions on use of various kinds of economic means and policies, making report on the plan of national economic and social development to the National People's Congress upon entrustment by the State Council.
(2) Studying and analyzing the economic situations and development status home and abroad, and giving predictions and pre-cautions of macro-economy; studying important issues involving security of the national economy, presenting suggestions on macro-control policies, and coordinating the economic and social development in a comprehensive way; adjusting the daily economic operations, and organizing settlement of the relevant major problems in economic operations.
(3) Gathering and analyzing information in respect of finance and banking, participating in the formulation of finance policies and currency policies, drawing up and organizing the implementation of industrial policies and price policies; analyzing the effects of execution of policies on public finance, banking, industries, and price in a comprehensive way, and supervising and inspecting the execution of industrial and price policies; formulating and adjusting a few important commodity prices and important charging standards subject to state administration; being responsible for the total amount control, structure optimizing, and monitoring of foreign loans calculated on a full basis, and thus to keep the international balance.
(4) Studying the major issues concerning economic system reform and opening to the outside world, organizing formulation of the scheme on comprehensive economic system reform, and coordinating the reform schemes of relevant special economic systems; presenting suggestions on improving the socialist market economic system and on promoting development through reform and opening, and directing and promoting the overall economic system reform.
(5) Presenting the total scale of investment in fixed assets of the whole society, and planning the layouts of the significant projects and productivity; arranging construction funds of state finance, directing and supervising the use of the construction funds of domestic and foreign loans, and guiding and supervising the direction of use of policy-oriented loans; guiding civil funds to be used in the investment of fix assets; studying and proposing the targets and policies of strategies, total amount balance and structure optimizing for utilization of foreign investment and making overseas investment; arranging for the construction projects financed by state funds, significant construction projects, significant foreign investment projects, overseas resource development projects, and investment projects using large amount of foreign exchange; organizing and administering the work of the special supervisors of significant projects.
(6) Promoting the strategic adjustment and upgrade of industrial structures; presenting the development strategies and planning of the major industries of the national economy; studying and coordinating the relevant major issues concerning agriculture and economic and social development of rural areas, and connecting the special planning and policies of the rural areas; directing industrial development and promoting industrialization and informationization; formulating industrial planning, and directing the formulation of the laws and regulations on industrial technology and the industrial standards; drawing up development programs of energies, such as oil, natural gas, coal, and electric power; promoting the development of the high-tech industry, and carrying out macro-direction of technical advancement and industrial modernization; directing the absorbing and innovation of the major technology and major equipment sets introduced into China.
(7) Studying and analyzing the development status of regional economies and urbanization, presenting the planning on coordinated development of regional economies and on implementation of the strategy of vast development of western regions, and presenting the strategies and major policies and measures for urbanization development; seeing to the overall coordination and direction of regional economic cooperation.
(8) Studying and analyzing the market status both home and abroad, and seeing to the total amount balance and macro-control of important commodities; drawing up the plans of total imports and exports of important agriculture products, industrial products, and raw materials, supervising the execution of the plans, and adjusting the plans of total imports and exports according to the situations of economic operations; managing the state reserve of important materials and commodities, such as food, cotton, sugar, oil, and drugs; presenting the strategies and planning for the development of modern logistic industry.
(9) Making efforts in connecting the public undertakings, such as population and birth control, science and technology, education, culture, and public health, and national defense, with the development of national economy; presenting the policies on coordinated development and mutual promotion of economy and society, and coordinating the major issues concerning the development of public undertakings.
(10) Promoting the sustainable development strategy, studying and drawing up the planning on saving and comprehensive utilization of resources, participating in the formulation of ecological construction planning, presenting the policies on saving and comprehensive utilization of resources, and coordinating the major issues concerning ecological construction and resources saving and comprehensive utilization; organizing and coordinating the work of environmental protection.
(11) Studying the status of various kinds of ownership systems, presenting suggestions on optimizing the ownership system structure and the enterprise organizational structure, promoting the fair competition and joint development of enterprises of various kinds of ownership systems; studying and presenting the policies and measures on promotion of the development of small- and medium-sized enterprises and the non-state-owned economies, strengthening the macro-direction, and coordinating the major issues arising in the development.
(12) Studying and presenting the policies on promotion of employment, adjustment of income distribution, improvement of coordinated development of social security and economy, and coordinating the major issues concerning employment, income distribution, and social security.
(13) Drawing up and formulating the relevant administrative regulations and rules concerning the national economic and social development, and the economic system reform, and the opening to the outside world, and participating in the drafting and implementation of the relevant laws and administrative regulations.
(14) Undertaking other matters entrusted by the State Council.
Administering the State Grain Administration and the State Tobacco Monopoly Bureau according to the provisions of the State Council.
CHAPTER III INTERNAL ORGANIZATIONS
There are 26 functional organizations in SDRC according to the aforesaid major functions:
(1) General Office
This organization is responsible for the daily governmental affairs of the commission, such as holding meetings, transmitting documents, managing archives, confidentiality, secretary affairs, and information about government affairs, and the administrative affairs of the commission such as administration of finance and assets, and security work; it is responsible for organizing implementation of electric government affairs and the handling of complaint letters and visits.
(2) Policy Research Office
This organization is responsible for drafting important documents and promulgating information; and for organizing the study of the major issues concerning the economic and social development, reform and opening, and international economy.
(3) Development Planning Department
This organization is responsible for studying and presenting suggestions on national economic and social development strategies and on the planning of productivity layout; presenting the targets and policies of the long- and middle-term national economic and social development, the total quantity balance, and the structural adjustment; presenting the development strategies and major policies and measures for urbanization; drawing up the long- and middle-term planning on national economic and social development, and organizing the formulation of and coordinating the special planning and regional planning on economic and social development.
(4) General Department of National Economy
This organization is responsible for studying the economic situations both home and broad, giving predictions and pre-cautions of macro-economy, and proposing suggestions on safeguard of the national economic safety; organizing the study and presenting the annual plan on national economic and social development, including the targets and policies of annual total quantity balance, structure adjustment, and balance of important commodities; proposing suggestions on the macro-control targets of promoting economic increase, increasing employment, stabilizing the price, and keeping international balance, and on the use of various kinds of economic means and policies; drawing up and coordinating the plans of state reserve of important materials.
(5) Economic Operation Department (Office of Inter-Ministry Meeting of Reduction of Enterprises' Burden of the State Council)
This organization is responsible for monitoring and analyzing the economic operation situations of industry and transportation, organizing settlement of the relevant major problems in the economic operations of industry and transportation, and studying and proposing suggestions in respect of the economic operations of industry and transportation; organizing emergent dispatching of important materials and coordination of transportation; proposing suggestions to use state material reserve; administering the state drug reserve; and assuming the daily work of the Inter-Ministry Meeting of Reduction of Enterprises' Burden of the State Council.
(6) Department of Comprehensive Economic System Reform
This organization is responsible for studying the major issues concerning economic system reform and opening to the outside world; organizing drawing up of the scheme on comprehensive economic system reform, and coordinating the relevant special reform schemes; proposing suggestions on promotion of the economic system reform and on improving the socialist market economic system.
(7) Department of Investment in Fixed Assets
This organization is responsible for monitoring and analyzing the status of investment of the whole society in fixed assets, studying and setting the total scale, structure and fund source of the investment in fixed assets, and presenting the policies on adjustment and control of the investment in fixed assets of the whole society; proposing suggestions on the reform of investment and financing systems; and arranging the construction projects financed by state funds and the significant construction projects.
(8) Department of Industrial Policy
This organization is responsible for studying and analyzing the status of industrial development, organizing drawing up of comprehensive industrial policies, organizing and coordinating the formulation of special industrial policies, and supervising the implementation of the industrial policies; presenting guidance catalogues of the production capacities, techniques, and products that are encouraged, restricted, or eliminated by the state; studying the development strategies and major polices of the service industry, and coordinating the development of the service industry; proposing policy suggestions on optimizing of industrial structure, ownership system structure, and enterprise organizational structure.
(9) Department of Foreign Fund Utilization
This organization is responsible for studying the trends of international capital, monitoring and analyzing the status of China's utilization of foreign funds, presenting the strategies of utilization of foreign funds, and studying and coordinating the relevant major policies; controlling the total amount of, optimizing the structure of, and monitoring the full-scale foreign debts; presenting the planning on utilization of foreign investment, presenting the planning on loans from international financial organizations and foreign governments, and proposing the alternative above-quota projects; drawing up catalogues for guidance of the industries for foreign investment through consultation with the relevant departments; arranging the major above-quota foreign investment projects; presenting the planning and policies on the strategies, total amount, structures, and use of foreign exchange for making overseas investment; and arranging the projects of overseas resource development and the projects using large amount of foreign exchange.
(10) Department of Regional Economy (Office of the State Countermeasure and Coordination Group on Climate Change)
This organization is responsible for organizing the draw-up of the planning on regional economic development, and presenting the policies on regional economic development; coordinating the policies on land treatment, development, utilization, and protection, participating in the drawing up of the planning on balance and saving of water resource, and the planning on ecological construction and environmental treatment; coordinating the regional economic development, directing the regional economic cooperation, and coordinating the major issues concerning special economic zones and open areas; drawing up economic development plans and plans on replacing aids by employment opportunities for the former revolutionary base areas, areas inhabited by minority nationalities, remote and border areas and poverty-stricken areas; and assuming the daily work of the Office of the State Countermeasure and Coordination Group on Climate Change.
(11) Department of Rural Economy
This organization is responsible for studying the major issues concerning agriculture and rural economic development; proposing suggestions on the strategies of rural economic development and the reform of rural economic systems; connecting the development planning and policies of agriculture, forestry, irrigation, and meteorology.
(12) Energy Bureau (State Oil Reserve Office)
This organization is responsible for studying the development and utilization of energy home and abroad, and presenting the strategies and major policies on energy development; drawing up the planning on energy development, and proposing suggestions on the relevant system reform; administration of the energies, such as oil, natural gas, coal, and electric power; administering the state oil reserve; and presenting policies and measures for energy saving and development of new energies.
(13) Department of Transportation
This organization is responsible for studying the status of transportation development, and proposing suggestions on strategies and planning of transportation development and on system reform; drawing up the policies on promotion of transportation technology advancement, and carrying out macro-direction of transportation modernization.
(14) Department of Industry (Office of the State Work Group Leading the Performance of the Chemical Weapons Convention, the Office of Rare Earth, and the Office of Salt Industry Administration)
This organization is responsible for analyzing the industrial development status and studying the strategies for new ways of industrialized development; drawing up the planning on major industries and the industrial policies, proposing suggestions on the relevant system reform, and giving macro-direction of industrial modernization; directing the formulation of the laws and regulations on industrial technology and the industrial standards; directing the absorbing and innovation of the introduced major technology and major equipment sets; assuming the organization and coordination of the state's performance of the Chemical Weapons Convention; undertaking relevant work concerning the development of rare earth industry; and administering the salt industry.
(15) Department of High-Tech
This organization is responsible for studying the development trends of the high-tech industry and the industrial technology, and presenting strategies, planning, policies, key areas, and relevant construction projects of the high-tech industry development and industrial technology advancement; presenting policies on support of the development of key technology industries, and organizing the development and manufacturing of the significant industrialization model projects and major equipment sets that can promote and drive improvement of the national economy quality; organizing and promoting technical innovation and combination of production, study, and research, and promoting formation of new national economic industries.
(16) Department of Small- and Medium-sized Enterprises
This organization is responsible for studying the relevant issues concerning the development of small- and medium-sized enterprises and non-state-owned economies, and promoting the fair competition and joint development of economies of multiple ownership systems; studying the presenting the policies and specific measures for supporting the development of small- and medium-sized enterprises, and strengthening the macro-direction and support to the development of small- and medium-sized enterprises; directing and promoting small- and medium-sized enterprises' cooperation with foreign parties, and establishing and perfecting the service system for small- and medium-sized enterprises; coordinating the problems arising in the development of small- and medium-sized enterprises and non-state-owned economies.
(17) Department of Environment and Resource Comprehensive Utilization
This organization is responsible for studying and solving the major issues concerning the coordinated development and the economy and society and the environment and resources; presenting policies on resource conservation and comprehensive utilization, drawing up the planning on resources conservation and comprehensive utilization, and participating in the planning on environmental protection; organizing and coordinating the relevant work in connection with the environmental protection industry, and organizing and coordinating the work of promotion of clean production; organizing and coordinating the relevant significant model projects and the spreading and application of new products, new technologies, and new equipment.
(18) Department of Social Development
This organization is responsible for presenting the strategies of social development, and drawing up and coordinating the social development planning and annual plans; coordinating the policies on the development of population, culture, education, public health, sports, broadcasting, television & film, tourism, politics and law, and civil affairs; coordinating the major issues concerning the development and reform of public undertakings.
(19) Economic and Trade Department
This organization is responsible for monitoring and analyzing the market status home and abroad, and the total quantity balance and macro-control of important commodities; drawing up the plans of total imports and exports of important agricultural products, industrial products, and raw materials, supervising the execution of the plans, and adjusting the plans of total imports and exports according to the economic operation status; administering the state reserve of food and cotton, and directing and supervising the state ordering, reserve, replacement, and input; representing the strategies and planning on the development of modern logistic development, and coordinating the major problems in the reform of the circulation system.
(20) Department of Finance and Banking
This organization is responsible for studying and analyzing the capital balance of the whole society; studying the fiscal policies and currency policies, and the issues concerning the reform of the fiscal and banking systems, analyzing the execution of the fiscal and currency policies and proposing suggestions; presenting development strategies and policy suggestions for direct financing; participating in the determination of the overall scale, structure, and direction of the issuance of valuable securities; and studying and presenting the total quantity of insurance of and the investment direction of enterprise bonds.
(21) Department of Price
This organization is responsible for monitoring and predicting the change of the general price level, and presenting the targets and policies for adjustment and control of the general price level and the suggestions on price reform; drafting laws and regulations in respect of commodity prices and charges; drawing up policies on the important commodity prices and charges and organizing the implementation thereof; presenting the scope, principles, and methods of price administration; drawing up and adjusting the price and charge standards for the commodities subject to administration by the Central Government; and organizing investigation of the costs of important agricultural products.
(22) Department of Price Supervision and Inspection
This organization is responsible for directing the work of price supervision and inspection, organizing price inspections, and dealing with illegal acts and illegal cases concerning commodity prices and charges according to law; assuming the trial of illegal price cases involving central departments, provincial people's governments, and central enterprises; drafting the administrative regulations and rules on price supervision and inspection, and accepting the reconsideration cases and appellate cases against price punishment.
(23) Department of Employment and Income Distribution
This organization is responsible for studying the situations of employment, distribution of residents' income, and social security, presenting the employment planning, and presenting the policies on promotion of employment, adjustment of income distribution, improvement of coordinated development of social security and economy; organizing drawing up and demonstration of the schemes on relevant system reform, and coordinating and solving the relevant major problems.
(24) Department of Laws and Regulations
This organization is responsible for drafting the relevant laws, administrative regulations and rules; investigating and studying the execution of the relevant laws, administrative regulations and rules; and taking care of the relevant administrative reconsideration and responding to administration actions.
(25) Department of Foreign Affairs
This organization is responsible for the relevant matters of cooperation between SDRC and international organizations, and foreign governments and institutions; assisting the relevant departments in promoting the major foreign-related projects, and carrying out international economic survey; and taking care of the daily work of foreign affairs of the organizations of this Commission.
(26) Department of Personnel
This organization is responsible for, according to its administrative authority, the cadre administration and personnel work of the organizations of this Commission and the entities affiliated to this Commission.
And the party committee of this Commission is responsible for the party and masses work of the organizations of this Commission, the state administrations subject to this Commission, and the entities affiliated to this Commission.
CHPATER IV PERSONNEL ESTABLISHMENT
The authorized number of administrative personnel of SDRC is 890. Among which, there are 120 leaders at the level of department and bureau (including 1 general secretary, 3 deputy general secretaries, 4 directors and deputy directors of the State Bureau of Material Reserve, 3 principals of the Office of Special Supervisors of Major Projects, 2 principals of the Office of National Economy Mobilization, and 3 full-time secretaries of the Party Committee and the Disciplinary Committee).
CHPATER V OTHER MATTERS
(1) Division of relevant functions of SDRC and the Ministry of Commerce.
1. Administration of imports and exports of important commodities. SDRC is responsible for drawing up the plans of total imports and exports of important industrial products, raw materials, and important agriculture products, and the Ministry of Commerce is responsible for organizing the implementation within the total quantity determined by SDRC. With respect to food, cotton, and coal, SDRC shall, in conjunction with the Ministry of Commerce, make distribution within the plan of total imports and exports and coordinate the relevant policies.
2. Administration of foreign investment. The Catalogue for Guidance of the Industries for Foreign Investment shall be drawn up by SDRC in conjunction with the Ministry of Commerce, and be jointly promulgated by SDRC and the Ministry of Commerce.
3. Administration of overseas investment. Major overseas investment projects of resource development, such as crude oil and mines, and overseas investment projects using large amount of foreign exchange shall be subject to the examination and approval by SDRC. The establishment of enterprises (with the exception of financial enterprises) overseas by domestic enterprises shall be subject to ratification by the Ministry of Commerce.
(2) The Office of National Economy Mobilization, the Office of Special Supervisors of Major Projects, and the State Bureau of Material Reserve will be kept.
(3) The division of functions between SDRC and the relevant departments in respect of the industrialization of high-tech, and the administration of motor vehicle permit, will be further clarified in the provisions further made on "determination of functions, organizations, and establishment" of the relevant departments.
