Article 1. For the purpose of strengthening the forestry statistical work, guaranteeing the genuineness, timeliness and authoritativeness of the forestry statistical materials, these Measures are formulated in accordance with the Statistical Law of the People's Republic of China and Detailed Rules for the Implementation of the Statistical Law of the People's Republic of China.
Article 2. Those undertaking forestry statistical investigations and analysis, providing forestry statistical materials and consultation opinions and conducting forestry statistical supervision shall abide by these Measures.
Article 3. The forestry administrative departments at or above the county level, the forestry enterprises and public institutions, and the forestry statistical investigation objects shall, in strict accordance with statistical laws and regulations of the state, faithfully offer the statistical materials. None of them may refuse to report, delay the report of, falsely report, conceal, counterfeit or alter any statistical materials.
Article 4. A forestry administrative department at or above the county level shall, in pursuance of Article 18 of the Statistical Law of the People's Republic of China and in light of the needs of the forestry statistical task, set up a statistical institution or arrange full-time or part-time statistical personnel in the relevant institutions, and shall designate a statistical person-in-charge.
Article 5. The main functions of the statistical institution of the forestry administrative department at or above the county level or the statistical person-in-charge are:
(1) to organize, guide and comprehensively coordinate the forestry statistical work;
(2) to work out and organize the execution of the forestry statistical investigation plans and statistical investigation programs, to collect, arrange, analyze and provide forestry statistical materials;
(3) to work out forestry statistical standards and investigation forms; and
(4) to complete the relevant statistical investigation tasks of the state, to supervise and inspect the implementation of statistical regulations and systems.
Article 6. A forestry enterprise or public institution shall, in accordance with Article 19 of the Statistical Law of the People's Republic of China and in light of the needs of forestry statistical tasks, set up a statistical institution or arrange full-time or part-time statistical personnel in the relevant institution and designate a statistical person-in-charge to perform the functions of organizing and coordinating the forestry statistical work, completing the forestry statistical work and the forestry statistical investigation tasks, providing forestry statistical materials and managing the forestry statistical investigation forms of this enterprise or institution according to law.
A forestry enterprise or public institution shall set up professional technical titles for statistics in accordance with the relevant provisions of the state. The transfer of the personnel with professional technical titles and the statistical persons-in-charge shall be in line with the statistical laws and regulations of the state.
Article 7. The forestry statistical investigations shall be classified into general investigation, frequent investigation, investigation for once and pilot investigation.
The forestry statistical investigations may, in light of the relevant requirements, be made by mail, telegraph, telex, fax, electronic data exchange and e-mailing.
Article 8. A statistical investigation plan and investigation program shall be worked out for the forestry statistical investigations.
The statistical institution of a forestry administrative department shall organize the relevant functional institution to draw up a forestry statistical investigation plan and investigation program, which shall be subject to the examination and approval of the administrative person-in-charge of this department and shall be submitted to the National Bureau of Statistics or to the statistical institution of the local people's government at the same level for archival purposes. If the objectives of the statistical investigation aren't only limited to the forestry sector, the forestry statistical investigation plan and investigation program shall be submitted to the National Bureau of Statistics or to the statistical institution of the local people's government at the same level for examination and approval. If the forestry statistical investigation plan and investigation program are very important, they shall be submitted to the State Council or to the local people's government at the same level for examination and approval.
Article 9. The forestry statistical investigation plan and the investigation program shall be worked out according to the forestry statistical investigation projects.
The application documents for launching a forestry statistical investigation project shall include the project name, investigation organ and items, range, objectives, way, time, contents, etc. Furthermore, the application documents for launching an important forestry statistical investigation project shall include the demonstration materials and pilot materials.
If an application for launching a forestry statistical project doesn't meet the relevant requirements, the statistical institution of the forestry administrative department shall timely require the applicant to supplement or revise the relevant materials.
Article 10. A forestry statistical investigation project shall be subject to the examination and approval pursuant to the following functions and procedures:
(1) If the statistical investigation objects belong to the forestry sector, the relevant functional institution of the forestry administrative department shall put forward application documents for launching a statistical investigation project, which shall, after being subjected to the examination of the statistical institution of the forestry administrative department and examination and approval of the administrative person-in-charge of this department, be submitted to the National Bureau of Statistics or to the statistical institution of the local people's government at the same level for archival purposes; or
(2) If the statistical investigation objects are not only limited to the forestry sector, the statistical institution of the forestry administrative department shall organize the relevant functional institutions to put forward application documents for launching a statistical investigation project, which shall, after being approved by the administrative person-in-charge of this department upon examination, be submitted to the National Bureau of Statistics or to the statistical institution of the local people's government at the same level for examination and approval. As to the application documents for launching an important statistical investigation project, they shall be subject to the examination and approval of the State Council or of the local people's government at the same level.
Article 11. The statistical institution of the forestry administrative department shall, within 20 working days after it receives the applications documents for launching a forestry statistical investigation project, finish the relevant examination, approval and archival filing formalities.
Article 12. The statistical institution of the forestry administrative department shall, within 20 working days after it receives the approval or archival filing document for the forestry statistical investigation project issued by the examination and approval organ, submit a formal document about the investigation arrangement, investigation program and questionnaire specimen to the National Bureau of Statistics or to the statistical institution of the people's government at the same level.
The statistical institution of the forestry administrative department shall, within 20 working days from the day when the formal document about the investigation arrangement, investigation program and questionnaire specimen are approved or have undergone the archival filing formalities, issue them to the execution entity of the forestry statistical investigation project.
Article 13. With regard to an approved forestry statistical investigation project or a forestry statistical investigation project that has undergone the archival formalities, the statistical institution of the forestry administrative department or the execution entity of the forestry statistical investigation project shall, on the upper right corner of the relevant statistical statements, clearly indicate the legal mark, which includes the statement number, entity and its document number, approval organ and the approval document number or the archival filing organ and archival filing number, and the deadline of the valid period.
Article 14. The meanings of the forestry statistical investigation indicators, computation approaches, classified catalogues, statistical coding and statistical standards for other aspects shall be formulated by the National Bureau of Statistics uniformly.
Article 15. The valid period of an approved forestry statistical investigation project shall be determined in accordance with the following circumstances respectively:
(1) If the duration of the investigation does not exceed 1 year, it shall be valid for 2 years;
(2) If the duration of the general investigation, investigation for once or investigation does not exceed 1 year, the valid period will expire until the investigation materials are submitted; or (3) As to a forestry statistical investigation project that has undergone the archival filing formalities in the National Bureau of Statistics or in the statistical institution of the local people's government, it shall be valid for 3 years.
The valid period of a forestry statistical investigation project shall be computed from the date when the project is approved or from the date when the project has undergone the archival filing formalities.
Article 16. With regard to the statistical materials formed during the course of statistical investigations conducted by the execution entity of a forestry statistical project, the administrative person-in-charge of this entity or statistical person-in-charge shall examine them, sign his opinions and affix the seal of this entity on them.
Article 17. The forestry statistical materials shall be managed by the statistical institutions or statistical persons-in-charge of the forestry administrative departments, the forestry enterprises and public institutions in a centralized manner.
The forestry administrative departments, forestry enterprises and public institutions shall intensify the preservation and utilization management of forestry statistical materials and shall establish archives for the original materials, book accounts, statistical statements, electronic data and statistical materials.
Article 18. The forestry statistical materials that the relevant functional institutions of the forestry administrative department, forestry enterprises and public institutions are required to submit or to offer shall be subject to the examination and approval of the statistical institution of the forestry administrative department.
Article 19. The national forestry statistical materials shall be announced by the State Forestry Administration uniformly.
The local forestry statistical materials shall be announced by the forestry administrative department of the local people's government at or above the county level uniformly.
Article 20. The State Forestry Administration shall compile and publish the standard texts of national forestry statistical materials uniformly.
The national forestry statistical materials shall be published once a year. The statistical institution of the State Forestry Administration shall be responsible for the concrete work thereof.
Article 21. Awards shall be given to the full-time and part-time personnel of the statistical institutions who have made outstanding achievements in the forestry statistical work.
Article 22. Anyone who violates any statistical law or regulation in the forestry statistical work shall be subject to legal liabilities.
Article 23. These Measures shall be implemented as of July 1, 2005.
