PROVISION OF THE STANDARDS FOR SMALL AND MEDIUM ENTERPRISES (TRIAL) |

(Circular of the State Economic and Trade Commission, the State Development Planning Commission, the Ministry of Finance and the National Bureau of Statistics of China on Distributing the Provision of the Standards for Small and Medium Enterprises (Trial) (No.143 [2003]), February 19, 2003: For the implementation of the Law of the People's Republic of China on Promotion of Small and Medium Enterprises, the State Economic and Trade Commission, the State Development Planning Commission, the Ministry of Finance and the National Bureau of Statistics of China formulated the Provision of the Standards for Small and Medium Enterprises (Trial), which shall come into force as of the day of promulgation. The upper limit of the standards for medium and small enterprises provided in the Interim Provisions on the Standards for Medium and Small Enterprises shall be the lower limit of the standards for large enterprises, according to this, the National Bureau of Statistics departments shall set the statistics classifications of large, medium and small enterprises, and provide the corresponding statistics data; and on that basis, the relevant departments under the State Council shall carry out the relevant data analysis, and shall not fix any standards for enterprise classification not in line with the Interim Provisions of the Standards for Small and Medium Enterprises; in respect of the service industries in which no standards for enterprise classification are set, the relevant departments shall jointly promulgate the standards for enterprise classification according to the results of the general national investigation of the third industry) |

Article 1. These Provisions are formulated in accordance with the Law of the People's Republic of China on Promotion of Medium and Small Enterprises.
Article 2. The standards for medium and small enterprises shall be set according to the number of employees, sales amount, total amount of assets of the enterprise etc, and in light of the characteristics of the industries.
Article 3. These Provisions shall apply to the trades of industry, construction, transportation and post, wholesale and retail, lodging and food service. Among which, the industry includes mining, manufacturing, production and supply of electric power, gas and water. Standards for medium and small enterprises of the trades other than those provided in these standards shall be set forth separately.
Article 4. The standards for medium and small enterprises are:
Industry: medium and small enterprises must meet the following conditions: less than 2000 employees, or sales amount of less than 300 million yuan, or total amount of assets of less than 400 million. Among which, medium enterprises must concurrently meet these conditions: 300 employees or more, sales amount of 30 milliona yuan or more, and total amount of assets of 40 million yuan or more; and the rest are small enterprises.
Construction: medium and small enterprises must meet the following conditions: less than 3000 employees, or sales amount of less than 300 million yuan, or total amount of assets of less than 400 million yuan. Among which, medium enterprises must concurrently meet these conditions: 600 employees or more, sales amount of 30 milliona yuan or more, and total assets of 40 million yuan or more; the rest are small enterprises.
Wholesale and retail: in retail industry, medium and small enterprises must meet the following conditions: less than 500 employees, or sales amount of less than 150 million yuan. Among which, medium enterprises must concurrently meet these conditions: 100 employees or more, sales amount of 10 milliona yuan or more; the rest are small enterprises. In wholesale industry, medium and small enterprises must meet the following conditions: less than 200 employees, or sales amount of less than 300 million yuan. Among which, medium enterprises must concurrently meet these conditions: 100 employees or more, and sales amount of 30 million yuan or more; the rest are small enterprises.
Transportation and post: in transportation industry, medium and small enterprises must meet the following conditions: less than 3000 employees, or sales amount of less than 300 million yuan. Among which, medium enterprises must concurrently meet these conditions: 500 employees or more, and sales amount of 30 million yuan or more; the rest are small enterprises. In post industry, medium and small enterprises must meet the following conditions: less than 1000 employees, or sales amount of less than 300 million yuan. Among which, medium enterprises must concurrently meet these conditions: 400 employees or more, and sales amount of 30 million yuan or more; the rest are small enterprises.
Lodging and food service: medium and small enterprises must meet the following conditions: less than 800 employees, or sales amount of less than 150 million yuan. Among which, medium enterprises must concurrently meet these conditions: 400 employees or more, and sales amount of 30 million yuan or more; the rest are small enterprises.
Article 5. In these Provisions, the number of practicing personnel at the end of a year as used in the current statistics system shall be taken as the number of employees; the annual product sales income as used in the current statistics system shall be taken as the sales amount of industrial enterprises; the annual project settlement as used in the current statistics system shall be taken as the sales amount of construction enterprises; in wholesale and retail industries, the annual sales amount as used in the current statistics system shall be taken as the sales amount; in transportation and post industries, lodging and food service industries, the annual business income as used in the current statistics system shall be taken as the sales amount of enterprises; the total assets as used in the current statistics system shall be taken as the total amount of assets.
Article 6. These Provisions shall apply to the enterprises of various kinds of ownership systems and in various kinds of organizational forms that are established within the People's Republic of China pursuant to law.
Article 7. The determination of enterprise classifications shall be based on the statutory statistics data of the state statistics departments, and the method in which the enterprise files the application and the government makes the examination and approval will no longer by adopted.
Article 8. These standards shall come into force as of the date of their promulgation, the Standards for Classification of Large, Medium and Small Industrial Enterprises promulgated by the State Economic Commission and other four ministries and commissions in 1988, as well as the supplementary standards thereto promulgated in 1992 shall be repealed at the same time.
