CHAPTER I GENERAL PROVISIONS
Article 1. This Regulation is formulated according to the Statistics Law of the People's Republic of China for the purpose of scientifically and effectively organizing the national general surveys of agriculture and guaranteeing the accuracy and timeliness of the data of general surveys of agriculture.
Article 2. The general surveys of agriculture shall be targeted to comprehensively grasp the basic information about agriculture, the rural areas and farmers of our country, to provide a basis for the study and formulation of economic and social development strategies, plans and policies as well as for the scientific decision-making, and to provide statistical information services to agricultural production operators and the general public.
Article 3. The general surveys of agriculture shall be organized and conducted according to the principles of unified national leadership, division of labor and cooperation between departments and local level-by-level responsibility.
Article 4. State organs, social groups as well as the entities and individuals relating to general surveys of agriculture shall take an active part in and closely coordinate with the general surveys of agriculture according to the Statistics Law of the People's Republic of China and this Regulation.
Article 5. The offices of the leading group of general surveys of agriculture at various levels (hereinafter referred to offices of general surveys) as well as the personnel, census instructors and surveyors of offices of general surveys (hereinafter referred to surveyors) shall independently exercise the functions of investigation, reporting and supervision, and no entity or individual may intervene in it.
The leader of a region, department or entity shall not alter by himself the data of general surveys of agriculture provided by the offices of general surveys and the surveyors, nor may he order by force or incite the offices of general surveys, surveyors or objects under survey to alter the data of any general survey of agriculture or forge any false data, or retaliate against any person who refuses or resists to altering the data of any general survey of agriculture or to fabricate any data.
Article 6. The publicity departments at all levels shall make full use of the press, radio, television, internet or outdoor advertisements, and adopt various forms to seriously do a good a job in the publicity and mobilization work.
Article 7. The funds necessary for general surveys of agriculture shall be jointly borne by the Central Government and the local people's governments at various levels, be listed into the public financial budget for the corresponding year, and be allocated on time, so as to ensure the availability of funds in full amount.
The funds for general surveys of agriculture shall be uniformly managed, earmarked, and strictly controlled in the aspect of expenditure.
Article 8. The general surveys of agriculture shall be carried out once every ten years, any year with the mantissa of six shall be the year of a general survey, the standard time point shall be the 24 o'clock of December 31st of the year of general survey. The registration time for the general survey in a special region may be properly adjusted upon approval of the General Surveys of Agriculture Leading Group Office of the State Council.
CHAPTER II OBJECTS, SCOPE AND CONTENTS OF GENERAL SURVEYS OF AGRICULTURE
Article 9. The objects under general surveys of agriculture shall be the following individuals and entities within the territory of the People's Republic of China:
(1) rural residents, including rural agricultural production operators and other rural residents;
(2) county and township agricultural production operators;
(3) agricultural production entities;
(4) villagers' committees; and
(5) people's governments of the townships.
Article 10. The objects under general surveys of agriculture shall faithfully answer the inquiries of surveyors, timely fill in the forms of general survey of agriculture, and shall not make any false, hidden or late report, nor may refuse to make a report.
The objects under general surveys of agriculture shall assist the statistical organs of the people's governments at or above the country level and the investigation teams dispatched by the National Bureau of Statistics of China in supervision and inspection, faithfully reflect the conditions, provide relevant materials, and shall not refuse, shuffle or deter any inspection, nor may he or it transfer, hide, alter or destroy any original records, statistical ledgers, forms of general survey, accounting materials or other relevant materials.
Article 11. The scope of industry of general surveys of agriculture shall include: crop cultivation industry, forestry, animal husbandry, fishery as well as service industry to agriculture, forestry, animal husbandry and fishery.
Article 12. The contents of a general survey of agriculture shall include: agricultural production conditions, agricultural production and business activities, agricultural land use, rural labor force and employment, rural infrastructure, rural social services, living conditions of farmers, as well as townships, villagers' committees, and community environments.
The contents of a general survey of agriculture prescribed in the preceding Paragraph can be revised by the General Surveys of Agriculture Leading Group Office of the State Council according to the specific conditions.
Article 13. The overall investigation method shall be adopted for general surveys of agriculture. The Office of the Leading Group for General Surveys of Agriculture of the State Council can decide to adopt the spot inspection method for specific contents.
Article 14. The national statistical classification standards shall be adopted for the general surveys of agriculture.
Article 15. A scheme of general survey of agriculture shall be uniformly formulated by the Office of the Leading Group for General Surveys of Agriculture of the State Council.
The office of general survey of agriculture at the provincial level can work out additional agricultural survey forms in light of the requirements, and report them to the Office of the Leading Group for General Surveys of Agriculture of the State Council for approval and implementation.
CHAPTER III ORGANIZATION AND IMPLEMENTATION OF GENERAL SURVEYS OF AGRICULTURE
Article 16. The State Council will establish a Leading Group for General Surveys of Agriculture and the office thereof. The Leading Group for General Surveys of Agriculture shall be responsible for organizing and leading the national general surveys of agriculture. The Office of the Leading Group for General Surveys of Agriculture of the State Council shall be established within the National Bureau of Statistics of China and specifically take charge of the organization and coordination of the routine work of general surveys of agriculture.
Article 17. The local people's governments at various levels shall establish leading group for agricultural surveys and the offices thereof, which shall be responsible for organizing and implementing the general surveys of agriculture within their own administrative areas according to the uniform provisions and requirements of the Leading Group for General Surveys of Agriculture of the State Council and its office. The investigation teams dispatched by the National Bureau of Statistics of China shall, as the member entities of leading group for agricultural surveys and the offices thereof, participate in the organization and implementation of general surveys of agriculture.
The villagers' committees shall do a good job in the general surveys of agriculture of its own area under the guidance of the township people's government.
Article 18. The relevant departments of the State Council and the local people's governments at various levels shall actively participate in and closely cooperate with the general survey office to conduct the general surveys of agriculture.
The general surveys of agricultural production entities affiliated to the army and the armed police troops shall be organized and implemented respectively by the army and the armed police troops concerned.
The general surveys of agriculture of Sinkiang Production and Construction Corps. shall be organized and implemented by the Leading Group for General Surveys of Agriculture of Sinkiang Production and Construction Corps. and the office thereof.
Article 19. The on-the-spot registration for rural areas shall be implemented on the basis of general survey areas. The general survey areas shall be divided on the basis of the administrative areas of villagers' committees, and each area can be divided into several sub-divisions.
The on-the-spot registration for townships shall be conducted according to the scheme of general survey.
Article 20. One surveyor shall be arranged for each general survey sub-division to take charge of visits and registration. At least one general survey instructor shall be arranged for each general survey area to take charge of arranging, guiding and urging the work of surveyors or directly carrying out the visits and registration.
General survey instructors and surveyors shall mainly be village cadres, villagers team leaders and other local residents with a fairly high cultural level.
General survey instructors and surveyors shall be healthy and dutiful.
Article 21. The general survey office can, in light of the requirements of the work, employ or transfer from any other relevant entity persons for engaging in the general surveys of agriculture. The relevant entity shall actively recommend qualified persons to engage in the general surveys of agriculture.
The labor remunerations for the hired persons shall be paid by the employing entity. The wages for the persons transferred from other relevant entities shall be paid by their original entities, and their welfare treatments shall remain unchanged.
Proper working subsidies for survey instructors and surveyors shall be arranged in the funds for the general surveys of agriculture.
Article 22. The local general survey office shall offer professional trainings to the instructors and surveyors, and issue nationally uniform certificates of general survey instructors or surveyors to those persons that pass the examination.
Article 23. A surveyor has the right to inquire about the relevant entity or individual with respect to the general surveys of agriculture, request the relevant entity or individual to faithfully provide relevant conditions and materials and alter the untrue materials.
Article 24. A surveyor shall adhere to the principle of seeking truth from facts, scrupulously abide by the professional ethics, and refuse and resist illegal acts in the general surveys of agriculture.
A surveyor shall strictly enforce the general survey scheme, and shall not forge or alter any data of general survey of agriculture, nor may he order by force or incite the objects under survey to provide any false data.
A general survey instructor or surveyor shall, when carrying out any task of general survey, show his certificate of general survey instructors or surveyors.
Article 25. A surveyor shall directly interview the objects under general survey, make inquiries and reporting on the spot. After a general survey form is completed, the object under general survey shall affix his/its name or seal for confirmation. The object under general survey shall be responsible for the authenticity of the general survey data on which he has affixed his/its name or seal.
A surveyor shall be responsible for the coherence between the data registered, examined and inputted thereby and those on which the objects under general survey have affixed their names or seals.
The general survey office shall be responsible for the accuracy of the data it has processed and sorted out.
CHAPTER IV DATA HANDLING AND QUALITY CONTROL
Article 26. The handling scheme and implementation measures for data of general surveys of agriculture shall be formulated by the Office of the Leading Group for General Surveys of Agriculture of the State Council.
The local agricultural census office shall carry out data processing in accordance with the data handling scheme and implementation measures, and timely report the data level by level.
Article 27. The processing of data of general surveys of agriculture shall be organized and implemented by the offices of general surveys at or above the level of districted city.
Article 28. The general survey office shall do a good job in making backup copies of the data and putting them into the database, establish and perfect the database of general surveys of agriculture, as well as strengthen the routine management, maintenance and updating thereof.
Article 29. The State will establish a quality control system for the data of general surveys of agriculture.
The general survey office shall conduct quality control, check and acceptance on each link of the general survey.
Article 30. A quality control responsibility system shall be implemented to the surveyors.
A surveyor shall examine, review, check and accept the general survey data according to the general survey scheme.
Article 31. The Office of the Leading Group for General Surveys of Agriculture of the State Council shall uniformly organize the follow-up spot quality check of the data of general surveys of agriculture. The results of spot check shall be the important basis for appraising the quality of data of the whole country or all the provinces, autonomous regions, and municipalities directly under the Central Government.
CHAPTER V DATA ANNOUNCEMENT, MATERIAL MANAGEMENT, AND THE DEVELOPMENT AND APPLICATION
Article 32. The State will establish a publicity system of data of general surveys of agriculture.
The gathered data of general surveys of agriculture shall be timely announced to the general public except those that should be kept confidential.
The national data of general surveys of agriculture as well as main data of all the provinces, autonomous regions and municipalities directly under the Central Government shall be appraised by the Office of the Leading Group for General Surveys of Agriculture of the State Council and be promulgated together with the relevant department of the State Council.
The gazette of general survey of agriculture promulgated by the local general survey office shall be reported to the general survey office at the next higher level for examination and approval.
Article 33. The general survey office and surveyors shall keep confidential the materials of a single object under general survey collected in the general surveys of agriculture, and shall not use them for any purpose other than the general survey concerned.
Article 34. The general survey office shall do a good job in keeping and managing the data of general surveys of agriculture and providing services to the general public, and shall develop and apply the data.
Article 35. The statistical organ and relevant departments under the people's government at or above the county level can, according to the results of general surveys of agriculture, amend the historical data gotten from regular statistics, and the specific measures shall be formulated by the National Bureau of Statistics of China.
CHAPTER VI AWARDS AND PUNISHMENTS
Article 36. Any entity or individual that seriously implements this Regulation, is dedicated to his or its post, adheres to the principles and has made outstanding contributions shall be awarded.
Article 37. If the leader of a region, department or entity alters by himself the data of general surveys of agriculture, orders by force or incites the general survey office, surveyor or object under general survey to alter any data or forge any false data, or retaliates against those persons who refuse or resist the alteration of any data or the formulation of any false data, he shall be given administrative sanctions or disciplinary sanctions, and the statistical organ under the people's government at or above the county level or the investigation team dispatched by the National Bureau of Statistics of China shall circulate a notice on criticism; and if a crime is constituted, he shall be subject to criminal liabilities.
Article 38. If a surveyor fails to implement the general survey scheme, forges or alters any data, orders by force or incites the object under general survey to provide any false data, the statistical organ under the people's government at or above the county level or the investigation team dispatched by the National Bureau of Statistics of China shall order him to make correction and impose on him an administrative sanction or disciplinary sanction, or may circulate a notice on criticism.
Article 39. In case any object under general surveys of agriculture commits any of the following illegal acts, the statistical organ under the people's government at or above the county level or the investigation team dispatched by the National Bureau of Statistics of China shall order it/him to make correction and circulate a notice on criticism; if the circumstances are serious, the relevant principal and other persons held to be directly responsible shall be given administrative sanctions or disciplinary sanctions:
(1) Refusing or impeding the investigation conducted by the general survey office or surveyors according to law;
(2) Providing false or incomplete data of general surveys of agriculture;
(3) Failing to provide materials relating to general surveys of agriculture in time, and still failing to do so after being urged to make reports;
(4) Refusing, reshuffling or impeding the law enforcement inspection of general surveys of agriculture; or
(5) Transferring, hiding, altering or destroying original records, statistical ledgers, survey forms, accounting materials or other relevant materials when accepting the law enforcement inspection of general surveys of agriculture.
In case an agricultural production entity commits any of the illegal acts prescribed in the preceding Paragraph, the statistical organ under the people's government at or above the county level or the investigation team dispatched by the National Bureau of Statistics of China shall give it a warning, and may impose on it a fine of less than 50,000 yuan; and in case an agricultural production operator commits any of the illegal acts prescribed in the preceding Paragraph, the statistical organ under the people's government at or above the county level or the investigation team dispatched by the National Bureau of Statistics of China shall give him a warning, and may impose on him a fine of less than 10,000 yuan.
In case an object under general surveys of agriculture commits any of the illegal acts prescribed in Item (1) or (4) of Paragraph 1 of this Article, the public security organ shall give a public security punishment to it/him.
Article 40. In case any surveyor neglects his duties or abuses his post and causes serious consequences, he shall be given an administrative sanction or disciplinary sanction, and the statistical organ under the people's government at or above the county level or the investigation team dispatched by the National Bureau of Statistics of China may circulate a notice on criticism.
Article 41. A general survey office shall set up a tip-off telephone and mail box to accept tip-offs and supervisions of all circles of the society over the illegal acts in the general surveys of agriculture, and give awards to the persons who make contributions to such tip-offs.
CHAPTER VII SUPPLEMENTARY PROVISIONS
Article 42. This Regulation shall come into force as of the date of promulgation.
