The State Council hereby decides to make the following amendments to the Detailed Rules for the Implementation of the Statistics Law of the People's Republic of China: I. Article 6 shall be amended as: "The National Bureau of Statistics and its dispatched investigation groups and the statistical institutions of the people's governments at or above the county level are state organs for implementing statistical laws and rules, and are responsible for supervising and checking the implementation of statistical laws and rules, maintaining the authorities of the statistical institutions and personnel and investigating into and handling the acts in violation of statistical laws and rules." A new paragraph shall be added as Paragraph 2 and prescribe that: "The statistical institutions of the people's governments at or above the county level shall investigate into and handle the illegal statistical acts occurred within their respective administrative regions; and any illegal statistical act occurred during the course of statistical survey conducted by an investigation group as dispatched by the National Bureau of Statistics shall be investigated and handled by the investigation group that carries out this statistical survey." II. Article 21 shall be amended as: "The State will establish and improve a quality controlling and appraising system of statistical data so as to control and appraise important statistical data of all the provinces, autonomous regions, and municipalities directly under the Central Government." III. Item (3) of Paragraph 1 of Article 22 shall be amended as: "Organizing major general surveys of national conditions and national strength under the leadership of the State Council and jointly with the relevant departments, and organizing and coordinating sample national social and economic investigations;" and Item (7) shall be amended as: "Uniformly leading and administrating the investigation groups as dispatched by the National Bureau of Statistics". A new paragraph shall be added as Paragraph 2 and prescribe that: "The investigation groups as dispatched by the National Bureau of Statistics shall assume all the investigation tasks as assigned by the National Bureau of Statistics, independently carry out statistical surveys according to law, and independently report statistical data to the higher authorities." IV. Item (6) of Paragraph 1 of Article 23 shall be deleted. V. Item (2) of Paragraph 1 of Article 26 shall be amended as: "Reporting and providing statistical data in accordance with the relevant state provisions, and conducting statistical analysis and supervision of the implementation of the plans and the operational and managerial performances of their own entities". VI. Paragraph 1 of Article 33 shall be amended as: "In case any enterprise or public institution commits any act against Paragraph 1 of Article 27 of the Statistics Law, the statistical institution of the people's government at or above the county level or the investigation group as dispatched by the National Bureau of Statistics shall give it a warning and may punish it with a fine of less than 50,000 yuan." Paragraph 2 shall be amended as: "In case any individual industrial and commercial household commits any act against Paragraph 1 of Article 27 of the Statistics Law, the statistical institution of the people's government at or above the county level or the investigation group as dispatched by the National Bureau of Statistics shall give it a warning and may punish it with a fine of less than 10,000 yuan". This Decision shall come into force as of February 1, 2006. The Detailed Rules for the Implementation of the Statistics Law of the People's Republic of China shall be re-promulgated after it is revised according to this Decision. |
